These Terms of Service (“Terms”) are a binding agreement between you (“you,” “Subscriber”) and Thomas C. Thomasian (“Operator,” “we,” “us”), governing your use of the MyDocketSync website and application (the “Service”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
MyDocketSync is a productivity tool for attorneys that parses Rhode Island Judiciary court-schedule PDFs, syncs hearing appearances to your calendar through a subscription feed, and generates draft clerk correspondence. The Service is provided on a subscription basis.
You must be at least 18 and capable of forming a binding contract. You are responsible for the accuracy of your account information, for keeping your credentials secure, and for all activity under your account. Notify us promptly of any unauthorized use.
Subject to these Terms and your payment of applicable fees, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your internal professional purposes. The Service is licensed, not sold. We retain all right, title, and interest in the Service, including all software, designs, and content we provide.
You may not, and may not permit anyone to:
The Service is offered on a recurring subscription billed through our payment processor at $17 per month. By subscribing, you authorize recurring monthly charges until you cancel. You may cancel at any time, effective at the end of the current billing period; you will retain access through that period. Fees already paid for the current period are non-refundable except where required by law. We may change pricing prospectively on reasonable notice.
You retain ownership of the content you submit. You grant us a limited license to process that content solely to provide the Service to you. Our handling of your data — including the third-party processing of uploaded PDFs needed to parse them — is described in our Privacy Policy, which is incorporated into these Terms. The court schedules processed by the Service are public records published by the Rhode Island Judiciary. You represent that you have the authority to submit the content you upload.
You are solely responsible for your own compliance with the rules of professional conduct that govern you, including your duties of confidentiality and competence (in Rhode Island, including Rules of Professional Conduct 1.1 and 1.6). You are responsible for evaluating whether your use of the Service — and of the third-party subprocessors identified in our Privacy Policy — is appropriate for your matters. We are a vendor of a software tool; we do not provide legal services, supervise your practice, or assume any of your professional obligations.
MyDocketSync is an aid, not a system of record. The Service relies on automated parsing of court-issued documents, and that parsing can be incomplete, delayed, or wrong — it may misread a date, a courtroom, a location, or omit a hearing entirely.
You must independently verify every hearing date, time, courtroom, and location against the official court record and the court’s own notices. Do not rely on the Service as your sole source for any appearance, deadline, or filing. You assume full responsibility for confirming your court obligations. We are not responsible for any missed appearance, missed deadline, sanction, or other consequence arising from reliance on the Service.
We aim to keep the Service available but do not guarantee uninterrupted or error-free operation. We may modify, suspend, or discontinue features, or perform maintenance, at any time.
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE ACCURATE, RELIABLE, OR ERROR-FREE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, OR MISSED APPEARANCES OR DEADLINES, ARISING OUT OF OR RELATED TO THE SERVICE. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID US FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.
You agree to indemnify and hold us harmless from claims, damages, and expenses (including reasonable legal fees) arising out of your use of the Service, your content, or your violation of these Terms or of any third party’s rights.
You may stop using the Service and cancel at any time. We may suspend or terminate your access for breach of these Terms or for conduct that risks harm to the Service or others. On termination, your license ends; data handling after termination is described in our Privacy Policy.
We may update these Terms as the Service evolves. We will update the “Last updated” date and, for material changes, take reasonable steps to notify you. Continued use after changes take effect means you accept them.
These Terms are governed by the laws of the State of Rhode Island, without regard to its conflict-of-laws rules. The state and federal courts located in Rhode Island will have exclusive jurisdiction, and you consent to venue there.
If any provision is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. These Terms, together with the Privacy Policy, are the entire agreement between us regarding the Service.
